Ky objektiv, n\u00eb p\u00ebrmbajtjen e tij, parashikon edhe fushat kryesore ku do t\u00eb shtrihet analiza, si kompetencat e organeve, transparenca, efikasiteti dhe koordinimi mes tyre.<\/p>\n<p>S\u00eb pari, n\u00eb m\u00ebnyr\u00ebn sesi shprehet ky objektiv, p\u00ebrdoren fjal\u00ebt: p\u00ebrdit\u00ebsim dhe p\u00ebrmir\u00ebsim. Vlen t\u00eb p\u00ebrmendet k\u00ebtu se q\u00ebllimi i ndryshimeve n\u00eb kuadrin ligjor lidhet me p\u00ebrmir\u00ebsimin e funksionimit t\u00eb organeve n\u00eb rastet kur ligji ka penguar ose v\u00ebshtir\u00ebsuar pun\u00ebn e tyre, si dhe kur aktualiteti i ri k\u00ebrkon nj\u00eb rishikim t\u00eb dispozitave ekzistuese. Nuk \u00ebsht\u00eb detyr\u00eb e ligjit t\u00eb b\u00ebj\u00eb p\u00ebrdit\u00ebsim, ndaj kjo shprehje nuk i p\u00ebrshtatet natyr\u00ebs s\u00eb objektivit dhe duhet shmangur.<\/p>\n<p>S\u00eb dyti, nga analiza q\u00eb i b\u00ebhet m\u00ebnyr\u00ebs sesi \u00ebsht\u00eb shprehur ky objektiv, dallohet se ai i ka paravendosur se do t\u00eb duhet t\u00eb ket\u00eb ndryshimet n\u00eb ligj dhe\/apo rregullore, pa pritur ende rezultatet e nj\u00eb analize q\u00eb do t\u00eb kryhet rreth legjislacionit t\u00eb miratuar n\u00eb 2016 dhe, gjithashtu, nuk ka marr\u00eb n\u00ebkonsiderat\u00eb ndryshimet e fundit t\u00eb 2021 q\u00eb prekin element\u00eb t\u00eb r\u00ebnd\u00ebsish\u00ebm t\u00eb funksionimit t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb. Edhe nga m\u00ebnyra sesi jan\u00eb shprehur rezultatet e k\u00ebrkuara dhe masat e parashikuara p\u00ebr arritjen e objektivit, dallohet qart\u00ebsisht se rishikimi i ligjeve dhe rregulloreve \u00ebsht\u00eb nj\u00eb nd\u00ebr synimet e k\u00ebtij objektivi dhe afati i vendosur p\u00ebr k\u00ebto ndryshime \u00ebsht\u00eb viti 2021-2022, pra fillimi i veprimit t\u00eb SND II. Vlen t\u00eb kujtohet k\u00ebtu se ecuria strategjike e sektorit t\u00eb drejt\u00ebsis\u00eb mb\u00ebshtetet mbi nj\u00eb analiz\u00eb t\u00eb thell\u00eb t\u00eb sistemit t\u00eb m\u00ebparsh\u00ebm dhe ligjet e reform\u00ebs jan\u00eb produkt i k\u00ebsaj analize. N\u00eb funksion t\u00eb Q\u00ebllimit t\u00eb Politik\u00ebs 1, ky objektiv \u00ebsht\u00eb i diskutuesh\u00ebm n\u00ebse i shton vlera funksionimit t\u00eb organeve t\u00eb qeverisjes s\u00eb drejt\u00ebsis\u00eb apo vepron n\u00eb t\u00eb kund\u00ebrt, duke prodhuar pasiguri institucionale dhe shkaktuar deri n\u00eb moslejim t\u00eb ushtrimit n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur, nga legjislativi dhe ekzekutivi, t\u00eb funksioneve t\u00eb tyre.<\/p>\n<p>Gjithashtu, funksionimi i mekanizmit, n\u00eb funksion t\u00eb strategjis\u00eb s\u00eb ideuar t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb, nuk ka qen\u00eb t\u00ebr\u00ebsisht funksional p\u00ebrgjat\u00eb SND I dhe ende vijon t\u00eb ket\u00eb paplot\u00ebsi. I till\u00eb\u00ebsht\u00eb p\u00ebr shembull, rasti i ILD-s\u00eb, ku akoma nuk \u00ebsht\u00eb plot\u00ebsuar institucioni me inspektor\u00eb. Po k\u00ebshtu edhe rastet e KLGJ-s\u00eb dhe KLP-s\u00eb, t\u00eb cilat jan\u00eb ende duke hartuar kuadrin e brendsh\u00ebm rregullator t\u00ebr\u00ebsisht t\u00eb ri, pra nuk mund t\u00eb thuhet se ky kuad\u00ebr rregullator \u00ebsht\u00eb maturuar mjaftuesh\u00ebm p\u00ebr t\u00eb qen\u00eb i gatsh\u00ebm t\u2019i n\u00ebnshtrohet nj\u00eb procesi analize e m\u00eb tej ndryshimit t\u00eb tij.<\/p>\n<p>S\u00eb treti, vet\u00eb fokusi i Q\u00ebllimit t\u00eb Politik\u00ebs 1 q\u00ebndron n\u00eb zbatimin e reform\u00ebs, n\u00eb forcimin e kapaciteteve t\u00eb institucioneve t\u00eb qeverisjes s\u00eb gjyq\u00ebsorit, dhe jo n\u00eb ridizenjimin e saj. Edhe pse hartuesit e dokumentit strategjik mund t\u00eb jen\u00eb nisur nga nj\u00eb qasje funksionale me synim p\u00ebrmir\u00ebsimin e element\u00ebve q\u00eb shikohen si problematik\u00eb n\u00eb ligj (duke mbajtur n\u00eb konsiderat\u00eb se nj\u00eb ligj apo rregullore, sado mir\u00eb t\u00eb ken\u00eb parashikuar apo sado af\u00ebr t\u00eb jen\u00eb me arritjen e objektivave t\u00eb tyre, mund t\u00eb ket\u00eb element\u00eb, t\u00eb cil\u00ebt do t\u00eb duhet t\u00eb analizohen <em>ex post<\/em> dhe t\u00eb p\u00ebrmir\u00ebsohen), vendosja e rishikimeve ligjore si nj\u00eb objektiv m\u00eb vete, me masa konkrete t\u00eb parashikuara p\u00ebr institucionet e qeverisjes (analiza e zbatimit t\u00eb ligjit nga institucionet e drejt\u00ebsis\u00eb, p\u00ebrgatitja e p\u00ebrgjigjes mbi analiz\u00ebn e rishikimit t\u00eb ligjit, finalizimi i rishikimit t\u00eb kuadrit ligjor n\u00eb dokumentin strategjik 2021-2025), nuk \u00ebsht\u00eb e p\u00ebrshtatshme. Mosparashikimi n\u00eb SND II i k\u00ebtij objektivi sigurisht q\u00eb nuk do t\u00eb hiqte dhe as nuk do t\u00eb zbehte asnj\u00eb nism\u00eb apo analiz\u00eb t\u00eb organeve apo pushtetit ligjv\u00ebn\u00ebs p\u00ebr t\u00eb nd\u00ebrhyr\u00eb n\u00eb k\u00ebto ligje, por, ama, do t\u00ebshmangte iden\u00eb se ndryshimi i ligjeve q\u00eb rregullojn\u00eb qeverisjen e gjyq\u00ebsorit po i n\u00ebnshtrohet s\u00ebrish nj\u00eb procesi ndryshimi strategjik.<\/p>\n<p><strong><em>Konkluzion<\/em><\/strong><em>: Vendosja e rishikimeve ligjore si nj\u00eb objektiv m\u00eb vete i SND II, me masa konkrete t\u00eb parashikuara p\u00ebr institucionet e qeverisjes nuk \u00ebsht\u00eb e p\u00ebrshtatshme. Mosparashikimi n\u00eb SND II i k\u00ebtij objektivi nuk do t\u00eb hiqte dhe as nuk do t\u00eb zbehte nisma apo analiza t\u00eb organeve apo pushtetit ligjv\u00ebn\u00ebs p\u00ebr t\u00eb nd\u00ebrhyr\u00eb n\u00eb k\u00ebto ligje, por, ama, do t\u00eb shmangte iden\u00eb se ndryshimi i ligjeve q\u00eb rregullojn\u00eb qeverisjen e gjyq\u00ebsorit po i n\u00ebnshtrohet s\u00ebrish nj\u00eb procesi ndryshimi strategjik<\/em>.<em> N\u00eb k\u00ebt\u00eb stad, theksi i Strategjis\u00eb duhet t\u00eb jet\u00eb tek zbatimi i kuadrit ligjor dhe detyrat e organeve t\u00eb reja t\u00eb qeverisjes s\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb.
