Meq\u00ebn\u00ebse n\u00eb Q\u00ebllimin e Politik\u00ebs 1 \u00ebsht\u00eb siguruar nj\u00eb mekaniz\u00ebm i ri, i ndrysh\u00ebm nga i m\u00ebparshmi, i analizuar si problematik pasi nuk siguronte paan\u00ebsi, eficenc\u00eb, transparenc\u00eb, llogaridh\u00ebnie, etj., mekanizmi i ri, n\u00ebp\u00ebrmjet institucioneve t\u00eb reja dhe ligjeve t\u00eb reja, do t\u00eb duhet t\u00eb ket\u00eb efekte pozitive n\u00eb sistemin gjyq\u00ebsor.<\/p>\n<p>K\u00ebto efekte t\u00eb d\u00ebshiruara shprehen qart\u00eb n\u00eb Q\u00ebllimin e Politik\u00ebs 2 dhe lidhen me performanc\u00ebn e gjyq\u00ebsorit n\u00eb t\u00ebr\u00ebsi. Gjyq\u00ebsori do t\u00eb duhet t\u00eb nd\u00ebrtoj\u00eb nj\u00eb marr\u00ebdh\u00ebnie sa m\u00eb transparente me publikun dhe p\u00ebrdoruesit e tij, t\u00eb jet\u00eb i aksesuesh\u00ebm p\u00ebr pal\u00ebt, t\u00eb veproj\u00eb shpejt n\u00eb koh\u00eb dhe t\u00eb jet\u00eb efikas. Gjithashtu, Q\u00ebllimi i Politik\u00ebs 2\u00a0 orienton se n\u00eb p\u00ebrmbushjen e k\u00ebtyre standardeve do t\u00eb duhet t\u00eb merret parasysh ligji shqiptar dhe standardet evropiane.<\/p>\n<p>SND I parashikonte nj\u00eb objektiv strategjik thuajse t\u00eb nj\u00ebjt\u00eb, Objektivi Strategjik 3: \u201cP\u00ebrmir\u00ebsimi i operimit t\u00eb sistemit gjyq\u00ebsor duke forcuar efikasitetin, transparenc\u00ebn dhe qasjen e tij n\u00eb p\u00ebrputhje me standardet evropiane\u201d. Ky parashikim duket se p\u00ebrshtatet plot\u00ebsisht me linj\u00ebn e ndjekur nga Strategjia Komb\u00ebtare p\u00ebr Zhvillim dhe Integrim (SKZHI) 2015-2020, sipas t\u00eb cil\u00ebs, gjyq\u00ebsori duhet t\u00eb ishte transparent dhe duhet t\u00eb fitonte besimin e publikut. Megjithat\u00eb, SND I, n\u00ebn k\u00ebt\u00eb objektiv strategjik, parashikonte edhe masa q\u00eb lidheshin me aksesin e publikut<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a>. Pra, duket se n\u00eb Strategjin\u00eb e re, k\u00ebrkesa q\u00eb\u00ebsht\u00eb shtuar ndaj gjyq\u00ebsorit lidhet me rritjen e aft\u00ebsis\u00eb profesionale t\u00eb tij, gj\u00eb q\u00eb duhet t\u00eb ishte shprehur edhe n\u00eb formulimin e Q\u00ebllimit t\u00eb Politik\u00ebs 2. Kjo \u00ebsht\u00eb nj\u00eb k\u00ebrkes\u00eb tejet e r\u00ebnd\u00ebsishme dhe me pasoja afatgjata dhe parashikimi i saj n\u00eb m\u00ebnyr\u00eb t\u00eb shkruar, e m\u00eb tej zb\u00ebrthimi i saj n\u00eb objektiva dhe masa konkrete, \u00ebsht\u00eb i domosdosh\u00ebm.<\/p>\n<p>R\u00ebnd\u00ebsia e k\u00ebsaj politike vihet re edhe n\u00eb p\u00ebrcaktimin e pes\u00eb objektivave specifik\u00eb<a href=\"#_ftn2\" name=\"_ftnref2\"><sup>[2]<\/sup><\/a>, kat\u00ebr prej t\u00eb cil\u00ebve do t\u00eb analizohen n\u00eb vijim p\u00ebr shkak t\u00eb r\u00ebnd\u00ebsis\u00eb s\u00eb tyre p\u00ebr funksionimin e sistemit t\u00eb drejt\u00ebsis\u00eb. Ky studim nuk ka marr\u00eb n\u00eb analiz\u00eb vet\u00ebm objektivin q\u00eb lidhet me Gjykat\u00ebn Kushtetuese, p\u00ebr shkak t\u00eb karakterit t\u00eb saj t\u00eb ve\u00e7ant\u00eb jasht\u00eb sistemit gjyq\u00ebsor tre shkall\u00ebsh dhe rregullave t\u00eb ve\u00e7anta q\u00eb lidhen me gjykimin n\u00eb GjK.<\/p>\n<p>Nisur nga m\u00ebnyra se si \u00ebsht\u00eb formuluar, duket se fokusi i k\u00ebtij q\u00ebllimi politik \u00ebsht\u00eb \u2018gjyq\u00ebsori\u2019 dhe jo\u2018sistemi i drejt\u00ebsis\u00eb\u2019, edhepse ekziston nj\u00eblidhje me prokurorin\u00eb dhe organizmin e saj, si p\u00ebrshembull n\u00eb rastin e miratimit t\u00eb hart\u00ebs gjyq\u00ebsore, e cila impakton drejtp\u00ebrdrejt\u00eb edhe funksionimin e prokuroris\u00eb.<\/p>\n<p><strong><em>Konkluzion<\/em><\/strong><em>: Q\u00ebllimi i Politik\u00ebs 2 ka nj\u00eb pesh\u00eb t\u00eb vecant\u00eb n\u00eb Strategji dhe nj\u00eb r\u00ebnd\u00ebsi t\u00eb madhe p\u00ebr k\u00ebt\u00eb studim, p\u00ebr shkak t\u00eb rezultateve konkrete q\u00eb k\u00ebrkon p\u00ebrmbushja e tij. P\u00ebr k\u00ebt\u00eb arsye, sugjerohet t\u00eb plot\u00ebsohet formulimi i tij me k\u00ebrkes\u00ebn p\u00ebr profesionaliz\u00ebm t\u00eb gjyq\u00ebsorit.<\/em><\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a>SND I, n\u00eb objektivin strategjik 3, parashikonte disa masa: \u20183.01.P\u00ebrmir\u00ebsimi i legjislacionit me q\u00ebllim p\u00ebrmir\u00ebsimin e efikasitetit t\u00eb procedurave gjyq\u00ebsore n\u00eb ve\u00e7anti n\u00ebp\u00ebrmjet: -p\u00ebrmir\u00ebsimit t\u00ebsistemit t\u00eb njoftimeve;-sigurimit t\u00eb mjeteve q\u00eb parandalojn\u00eb shtyrjen e gjykimeve,- futjes s\u00eb procedurave t\u00eb p\u00ebrshpejtuara; &#8211; kritereve t\u00eb filtrimit; -k\u00ebrkimit t\u00eb arsyetimit n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb me vendimin e gjykat\u00ebs \/ me shpalljen e vendimit; 3.02.Krijimi i nj\u00eb sistemi t\u00eb arsyesh\u00ebm dhe proporcional t\u00eb tarifave gjyq\u00ebsore p\u00ebr t\u00eb siguruar financimin e sh\u00ebrbimeve t\u00eb drejt\u00ebsis\u00eb, si dhe garantimin e aksesit n\u00eb gjykat\u00eb; 3.03.
