N\u00eb m\u00ebnyr\u00eb q\u00eb ky akses t\u00eb jet\u00eb sa m\u00eb efektiv p\u00ebr qytetar\u00ebt duhet t\u00eb \u2018investohet\u2019 n\u00eb shum\u00eb drejtime. P\u00ebr nga m\u00ebnyra se si \u00ebsht\u00eb formuluar, ky Objektiv fokusohet n\u00eb tre drejtime: (i) tek ndihma juridike; (ii) zgjidhjet alternative t\u00eb mosmarr\u00ebveshjeve; dhe (iii) hartimi i tarifave t\u00eb p\u00ebrshtatshme gjyq\u00ebsore. T\u00eb tria k\u00ebto aspekte, megjith\u00ebse jo t\u00eb vetmet, jan\u00eb shum\u00eb t\u00eb r\u00ebnd\u00ebsishme p\u00ebr t\u00eb siguruar aksesin n\u00eb drejt\u00ebsi.<\/p>\n<p>E drejta p\u00ebr ndihm\u00eb juridike siguron akses efektiv n\u00eb drejt\u00ebsi p\u00ebr ata q\u00eb kan\u00eb pamjaftueshm\u00ebri burimesh financiare p\u00ebr t\u00eb mbuluar kostot e \u00e7\u00ebshtjeve gjyq\u00ebsore, si\u00e7 jan\u00eb tarifat ose shpenzimet gjyq\u00ebsore t\u00eb p\u00ebrfaq\u00ebsimit ligjor.<\/p>\n<p>Zgjidhja alternative e mosmarr\u00ebveshjeve (ZAM) i referohet procedurave t\u00eb zgjidhjes s\u00eb mosmarr\u00ebveshjeve &#8211; si nd\u00ebrmjet\u00ebsimi dhe arbitrazhi-q\u00eb ofrojn\u00eb zgjidhje jasht\u00ebgjyq\u00ebsore p\u00ebr mosmarr\u00ebveshjet. Aplikimi i tyre p\u00ebrmir\u00ebson efikasitetin e drejt\u00ebsis\u00eb, duke zvog\u00ebluar ngarkes\u00ebn e pun\u00ebs s\u00eb gjykatave dhe duke u ofruar individ\u00ebve nj\u00eb mund\u00ebsi p\u00ebr t\u00eb zgjidhur mosmarr\u00ebveshjet n\u00eb nj\u00eb koh\u00eb m\u00eb t\u00eb shpejt\u00eb dhe me m\u00eb pak kosto financiare e sociale.<\/p>\n<p>Tarifat gjyq\u00ebsore duhet t\u00eb jen\u00eb t\u00eb studiuara n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb ndihmojn\u00eb administrimin efikas t\u00eb drejt\u00ebsis\u00eb. Ato, nga nj\u00ebra an\u00eb, nuk duhet t\u00eb r\u00ebndojn\u00eb pal\u00ebt me kosto t\u00eb tep\u00ebrta q\u00ebi pengojn\u00eb t\u2019i drejtohen gjykat\u00ebs p\u00ebr shkelje t\u00eb t\u00eb drejtave, si dhe, nga ana tjet\u00ebr, duhet t\u00eb mbulojn\u00eb kostot administrative dhe t\u00eb pengojn\u00eb pal\u00ebt q\u00eb abuzojn\u00eb me t\u00eb drejt\u00ebn p\u00ebr t\u2019iu drejtuar gjykat\u00ebs.<\/p>\n<p>Ky Objektiv \u00ebsht\u00eb n\u00eb p\u00ebrputhje me Q\u00ebllimin e Politik\u00ebs 2, nj\u00eb nd\u00ebr drejtimet e s\u00eb cil\u00ebs \u00ebsht\u00eb fuqizimi i aksesit n\u00eb drejt\u00ebsi n\u00eb p\u00ebrputhje me k\u00ebrkesat kushtetuese, ligjore dhe standardet evropiane.Objektivi 2.5 gjithashtu vjen n\u00eb vijim\u00ebsi t\u00eb objektivave t\u00eb SNDI. Konkretisht N\u00ebn-objektivi 3\/b: \u201c<em>P\u00ebrmir\u00ebsimi i aksesit n\u00eb sistemin e drejt\u00ebsis\u00eb<\/em>, ishte pjes\u00eb e Objektivit 3 t\u00eb SND I: <em>P\u00ebrmir\u00ebsimi i funksionimit t\u00eb sistemit gjyq\u00ebsor duke forcuar efikasitetin, transparenc\u00ebn dhe qasjen n\u00eb gjykat\u00eb n\u00eb p\u00ebrputhje me standardet evropiane<\/em>.\u201d<\/p>\n<p>Objektivi 2.5 i p\u00ebrgjigjet gjithashtu nevojave aktuale t\u00eb shoq\u00ebris\u00eb. Sistemi i ndihm\u00ebs juridike \u00ebsht\u00eb n\u00eb faz\u00eb konsolidimi. Pas hartimit t\u00eb baz\u00ebs ligjore dhe shtimit t\u00eb rrjetit t\u00eb qendrave t\u00eb ofrimit t\u00eb ndihm\u00ebs juridike, sfid\u00eb mbetet nd\u00ebrgjegj\u00ebsimi i qytetar\u00ebve mbi kushtet e p\u00ebrfitimit t\u00eb saj dhe rritja e numrit t\u00eb atyre q\u00eb p\u00ebrfitojn\u00eb ndihm\u00eb juridike par\u00ebsore dhe dyt\u00ebsore falas.<\/p>\n<p>Alternativat e zgjidhjes s\u00eb mosmarr\u00ebveshjeve, me gjith\u00eb ndihm\u00ebn q\u00eb do t\u00eb mund t\u2019i ofronin qytetar\u00ebve dhe sistemit gjyq\u00ebsor, mbeten jo-efektive dhe duhet q\u00eb, p\u00ebrve\u00e7 nd\u00ebrgjegj\u00ebsimit, t\u00eb b\u00ebhet nj\u00eb analiz\u00eb e baz\u00ebs aktuale ligjore, duke evidentuar pikat e dob\u00ebta, si dhe duke e sjell\u00eb at\u00eb n\u00eb p\u00ebrputhje me modelet e suksesshme, t\u00eb cilat shmangin k\u00ebto probleme dhe i p\u00ebrshtaten realitetit shqiptar.<\/p>\n<p>Gjithashtu, tarifat gjyq\u00ebsore jan\u00eb t\u00eb nevojshme p\u00ebr t\u2019u rishikuar, duke marr\u00eb n\u00eb konsiderat\u00eb organizimin e sistemit n\u00eb baz\u00eb t\u00eb hart\u00ebs s\u00eb re gjyq\u00ebsore.<\/p>\n<p>Ky objektiv materializohet n\u00eb 3 rezultate<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>. K\u00ebto rezultate jan\u00eb t\u00eb plota dhe n\u00eb p\u00ebrputhje me Objektivin 2.5. Sugjerojm\u00eb q\u00eb Rezultati 2.5.2 t\u00eb riformulohet n\u00eb form\u00ebn e nj\u00eb rezultati pasi ka m\u00eb tep\u00ebr natyr\u00ebn e nj\u00eb mase gjith\u00ebp\u00ebrfshir\u00ebse. P\u00ebr shembull, mund t\u00eb formulohet: \u201c<em>Mekanizma efektive\u00a0 <\/em><em>p\u00ebr zgjidhjen alternative t\u00eb mosmarr\u00ebveshjeve<\/em>\u201d. E nj\u00ebjta v\u00ebrejtje vlen edhe p\u00ebr Rezultatin 2.5.3. Edhe ky rezultat duhet t\u00eb riformulohet n\u00eb p\u00ebrputhje me natyr\u00ebn e nj\u00eb rezultati. P.sh \u201c<em>Tarifa t\u00eb studiuara t\u00eb cilat maksimizojn\u00eb aksesin n\u00eb drejt\u00ebsi, me fokus grupet vulnerab\u00ebl\u201d<\/em>. Nga m\u00ebnyra se si \u00ebsht\u00eb shkruar ky rezultat parashikon rritje tarifash, duke paragjykuar rezultatet e nj\u00eb analize t\u00eb thell\u00eb t\u00eb sistemit t\u00eb tarifimit, i cili n\u00eb vetvete duhet t\u00eb gjej\u00eb nj\u00eb balanc\u00eb t\u00eb sh\u00ebndetshme mes aksesit n\u00eb drejt\u00ebsi, kostove administrative t\u00eb procesit, si dhe identifikimin e drejt\u00eb t\u00eb kategorive q\u00eb p\u00ebrjashtohen nga tarifimi i sh\u00ebrbimeve gjyq\u00ebsore. N\u00eb k\u00ebt\u00eb analiz\u00eb duhet t\u00eb merret n\u00eb konsiderat\u00eb edhe organizimi dhe shp\u00ebrndarja e b\u00ebr\u00eb sipas hart\u00ebs s\u00eb re gjyq\u00ebsore. Referuar masave t\u00eb parashikuara p\u00ebr k\u00ebt\u00eb objektiv, mendojm\u00eb q\u00eb institucione pjesmarr\u00ebse duhet t\u00eb jen\u00eb gjithashtu Dhoma Komb\u00ebtare e Avokatis\u00eb (p\u00ebr pjes\u00ebn e trajnimit t\u00eb avokat\u00ebve), Shkolla e Magjistratur\u00ebs dhe Gjyq\u00ebsori (p\u00ebr pjes\u00ebn e nd\u00ebrgjegj\u00ebsimit dhe trajnimit vazhdues t\u00eb gjyqtar\u00ebve lidhur me ndihm\u00ebn juridike falas).<\/p>\n<p><strong><em>Konkluzion:<\/em><\/strong><em>Ky objektiv \u00ebsht\u00eb n\u00eb p\u00ebrputhje me Q\u00ebllimin e Politik\u00ebs 2.\u00a0 Ai \u00ebsht\u00eb i qart\u00eb, i nevojsh\u00ebm dhe realist.
