N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, nj\u00ebher\u00ebsh me vler\u00ebn informuese, form\u00ebsohet nj\u00eb marr\u00ebdh\u00ebnie e vazhdueshme, llogaridh\u00ebnie e besimi, nd\u00ebrmjet individit dhe shtetit.<\/p>\n<p>Kjo q\u00eb p\u00ebrshkruam me k\u00ebt\u00eb paragraf t\u00eb par\u00eb \u00ebsht\u00eb ajo cfar\u00eb ne mendojm\u00eb se duhet t\u00eb p\u00ebrb\u00ebj\u00eb qasjen edhe t\u00eb Strategjis\u00eb Nd\u00ebrsektoriale t\u00eb Drejt\u00ebsis\u00eb ndaj shoq\u00ebris\u00eb. P\u00ebr shkak t\u00eb rolit t\u00eb vecant\u00eb q\u00eb kan\u00eb c\u00ebshtjet e s\u00eb drejt\u00ebs, c\u00ebshtje q\u00eb lidhen jo thjesht me ligjin, por me frym\u00ebn, q\u00ebllimin dhe avancimin e tij n\u00eb shoq\u00ebri, ky studim paraqet nj\u00eb vler\u00eb t\u00eb vecant\u00eb pasi synon ta b\u00ebj\u00eb Strategjin\u00eb e Drejt\u00ebsis\u00eb nj\u00eb instrument t\u00eb qart\u00eb, t\u00eb preksh\u00ebm, t\u00eb matsh\u00ebm, edhe nga aktor\u00eb t\u00eb p\u00ebrfshir\u00eb n\u00eb m\u00ebnyr\u00eb jo t\u00eb drejtp\u00ebrdrejt\u00eb n\u00eb parashikimet e saj.<\/p>\n<p>Kjo \u00ebsht\u00eb arsyeja pse n\u00eb analiz\u00eb b\u00ebhet nj\u00eb lidhje kronologjike e logjike midis analiz\u00ebs s\u00eb gjendjes s\u00eb sitemit t\u00eb drejt\u00ebsis\u00eb, dokumenti i par\u00eb q\u00eb b\u00ebn q\u00eb skaner t\u00eb situat\u00ebs n\u00eb vend, Strategjis\u00eb s\u00eb Par\u00eb Nd\u00ebrsketoriale t\u00eb Drejt\u00ebsis\u00eb dhe Strategjis\u00eb aktuale, e cila p\u00ebrb\u00ebn faz\u00ebn e dyt\u00eb t\u00eb reform\u00ebs n\u00eb drejt\u00ebsi, sipas hartuesve t\u00eb saj.<\/p>\n<p>N\u00eb k\u00ebt\u00eb dokument analizues, grupi i ekspert\u00ebve ka nisur t\u00eb analizoj\u00eb s\u00eb pari, q\u00ebllimet politike t\u00eb SND II, t\u00eb cil\u00ebt jan\u00eb grupuar n\u00eb kat\u00ebr gjithsej, p\u00ebr t\u00eb par\u00eb n\u00ebse, n\u00eb kuadrin makro, ato q\u00ebndrojn\u00eb dhe jan\u00eb aktuale apo jo. Nj\u00eb nd\u00ebr c\u00ebshtjet m\u00eb t\u00eb debatueshme lidhet me q\u00ebllimin e Politik\u00ebs 3, e cila parashikon se tanim\u00eb do ti kushtohet r\u00ebnd\u00ebsi risocializimit, riintegrimit, rehabilitimit dhe respektimit t\u00eb t\u00eb drejtave t\u00eb njeriut, brenda nj\u00eb qasje t\u00eb integruar dhe me praktika t\u00eb forta p\u00ebr parandalimin e krimit. Sigurisht, \u00ebsht\u00eb e vler\u00ebsueshme se arritja e q\u00ebllimeve t\u00eb vendosura n\u00eb k\u00ebt\u00eb politik\u00eb nuk ndikon vet\u00ebm n\u00eb c\u00ebshtjet e kriminalitetit dhe politikave penale, por sh\u00ebnon edhe nj\u00eb hap drejt emancipimit social t\u00eb Shqip\u00ebris\u00eb dhe pranimit t\u00eb diferencave shoq\u00ebrore e respektimit t\u00eb t\u00eb drejtave t\u00eb njeriut, megjithat\u00eb, duke mos parashikuar nevoj\u00ebn p\u00ebr konsolidimin e institucioneve t\u00eb hetimit dhe gjykimit t\u00eb veprave penale, vecan\u00ebrisht korrupsionit, kjo politik\u00eb nuk \u00ebsht\u00eb e plot\u00eb, pasi nevoja p\u00ebr t\u2019a konsideruar k\u00ebt\u00eb komponent s\u00ebrish si q\u00ebllim t\u00eb reform\u00ebs edhe p\u00ebr kat\u00ebr vje\u00e7arin e dyt\u00eb \u00ebsht\u00eb shum\u00eb e r\u00ebnd\u00ebsishme dhe aktuale. Pra, p\u00ebr t\u00eb pasur nj\u00eb vijim\u00ebsi logjike dhe kronologjike, duke iu referuar edhe ngritjes s\u00eb organeve t\u00eb reja, hallka t\u00eb t\u00eb nj\u00ebjtit mekaniz\u00ebm (si p.sh. BKH), t\u00eb cilat nuk ishin parashikuar n\u00eb SND I, do t\u00eb ishte e nevojshme q\u00eb, Politika 3 t\u00eb p\u00ebrmbante t\u00eb shprehur r\u00ebnd\u00ebsin\u00eb e funksionimit efikas dhe eficent t\u00eb organeve t\u00eb hetimit. Duke qen\u00eb se nj\u00eb nd\u00ebr \u201cinvestimet\u201d m\u00eb t\u00eb m\u00ebdha n\u00eb sektorin e prokuroris\u00eb ishte ngritja e SPAK dhe BKH, edhe p\u00ebr shkak t\u00eb sensibilitetit t\u00eb lart\u00eb publik q\u00eb kan\u00eb c\u00ebshtjet q\u00eb hetojn\u00eb k\u00ebto organe, mir\u00ebqeverisja e prokuroris\u00eb dhe e hetimit n\u00eb Shqip\u00ebri do t\u00eb varet gjithashtu nga suksesi i k\u00ebtyre organeve. Nuk mund t\u00eb thuhet se n\u00eb kat\u00ebr vitet e SND I u arrit t\u00eb p\u00ebrmbyllej politika penale \u201cnd\u00ebshkuese\u201d, kur organet u krijuan me vones\u00eb dhe filluan t\u00eb japin rezultatet e para vet\u00ebm dy vitet e fundit. Qasja m\u00eb e p\u00ebrshtatshme k\u00ebrkon nj\u00eb bashk\u00ebekzistenc\u00eb t\u00eb t\u00eb dyja metodave, si nd\u00ebshkuese, edhe restauruese.<\/p>\n<p>S\u00eb dyti, jan\u00eb analizuar objektivat dhe rezultatet e parashikuara q\u00eb do t\u00eb duhet t\u00eb p\u00ebrmbushin k\u00ebto q\u00ebllime strategjike. Sipas analiz\u00ebs, n\u00eb shum\u00eb raste nuk \u00ebsht\u00eb respektuar nj\u00eb rrjedh\u00eb e natyrshme e kalimit t\u00eb reform\u00ebs nga nj\u00eb faz\u00eb n\u00eb tjetr\u00ebn. K\u00ebshtu, nuk mendohet se rishikimi i ligjeve duhet t\u00eb ishte nj\u00eb objektiv strategjik aq dominues sa t\u00eb k\u00ebrkonte analiz\u00ebn e rishikimin e t\u00eb gjitha ligjeve q\u00eb u hartuan n\u00eb kuad\u00ebr t\u00eb reform\u00ebs n\u00eb drejt\u00ebsi. Kjo sepse ecuria strategjike e sektorit t\u00eb drejt\u00ebsis\u00eb mb\u00ebshtetet mbi nj\u00eb analiz\u00eb t\u00eb thell\u00eb t\u00eb sistemit t\u00eb m\u00ebparsh\u00ebm dhe ligjet e reform\u00ebs jan\u00eb produkt i k\u00ebsaj analize. Ky objektiv \u00ebsht\u00eb i diskutuesh\u00ebm n\u00ebse i shton vlera funksionimit t\u00eb organeve t\u00eb qeverisjes s\u00eb drejt\u00ebsis\u00eb apo vepron n\u00eb t\u00eb kund\u00ebrt, duke prodhuar pasiguri institucionale dhe duke shkaktuar deri n\u00eb moslejim t\u00eb ushtrimit n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur, nga legjislativi dhe ekzekutivi, t\u00eb funksioneve t\u00eb tyre. Gjithashtu funksionimi i mekanizmit, n\u00eb funksion t\u00eb strategjis\u00eb s\u00eb ideuar t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb, nuk ka qen\u00eb t\u00ebr\u00ebsisht funksional p\u00ebrgjat\u00eb SND I dhe ende vijon t\u00eb ket\u00eb paplot\u00ebsi. Fokusi i faz\u00ebs s\u00eb dyt\u00eb t\u00eb reform\u00ebs q\u00ebndron n\u00eb zbatimin e reform\u00ebs, n\u00eb forcimin e kapaciteteve t\u00eb institucioneve t\u00eb qeverisjes s\u00eb gjyq\u00ebsorit, dhe jo n\u00eb ridizenjimin e saj. Edhe pse hartuesit e dokumentit strategjik mund t\u00eb jen\u00eb nisur nga nj\u00eb qasje funksionale me synim p\u00ebrmir\u00ebsimin e element\u00ebve q\u00eb shikohen si problematik\u00eb n\u00eb ligj (duke mbajtur n\u00eb konsiderat\u00eb se nj\u00eb ligj apo rregullore, sado mir\u00eb t\u00eb ken\u00eb parashikuar apo sado af\u00ebr t\u00eb jen\u00eb me arritjen e objektivave t\u00eb tyre, mund t\u00eb ket\u00eb element\u00eb, t\u00eb cil\u00ebt do t\u00eb duhet t\u00eb analizohen <em>ex post<\/em> dhe t\u00eb p\u00ebrmir\u00ebsohen), vendosja e rishikimeve ligjore si nj\u00eb objektiv m\u00eb vete, me masa konkrete t\u00eb parashikuara p\u00ebr institucionet e qeverisjes nuk mendohet t\u00eb jet\u00eb e p\u00ebrshtatshme p\u00ebr k\u00ebt\u00eb dokument strategjik.<\/p>\n<p>S\u00eb treti, jan\u00eb marr\u00eb n\u00eb analiz\u00eb t\u00eb gjitha ato masa q\u00eb jan\u00eb vler\u00ebsuar si m\u00eb relevante n\u00eb p\u00ebrmbushje t\u00eb rezultateve t\u00eb vendosura dhe konstatohet q\u00eb nuk jan\u00eb t\u00eb shumta, madje n\u00eb nj\u00eb pjes\u00eb t\u00eb madhe t\u00eb rasteve ato jan\u00eb t\u00eb paplota e t\u00eb paqarta. Studimi ka hedhur drit\u00eb mbi to dhe ka parashikuar p\u00ebrmir\u00ebsime t\u00eb mundshme apo interpretime q\u00eb i vijn\u00eb n\u00eb ndihm\u00eb qart\u00ebsimit t\u00eb mas\u00ebs.<\/p>\n<p>I nj\u00ebjti vler\u00ebsim \u00ebsht\u00eb b\u00ebr\u00eb edhe p\u00ebr indikator\u00ebt, t\u00eb cil\u00ebt vler\u00ebsohen nga analiza si t\u00eb pamjaftuesh\u00ebm p\u00ebr t\u00eb matur ecurin\u00eb e strategjis\u00eb.
